Trademark Registration Information
The U.S. Patent and Trademark Office (USPTO) (www.uspto.gov) is the governmental agency that examines and approves federal trademark registration applications. The U.S. has both a Principal and Supplemental Register, for information about their differences please read the Benefits of Registration IP Information Sheet. The USPTO assigns an examining attorney to Reviewing each application. Typically, the examining attorney contacts the prosecuting attorney (who filed the application) through correspondence called Office Actions. Through Office Actions, examining attorneys inform Applicants of any problems with the application. Typical problems include the manner of description of goods & services, a finding that the mark is “merely descriptive,” or a likelihood of confusion with a prior pending application or granted registration. The USPTO examines trademark registration applications against previously filed and registered marks on both Registers. As it is impossible to predict the nature of an office action, it is also impossible to predict the time it will take to respond thereto. Accordingly, billing for Office Actions responses is at an hourly rate.

The U.S. adheres to the International Classification System for goods and services. However, the U.S. requires a great deal more specificity in the recitation of goods and services than most countries. Further, the U.S. Government fees are per Classification, so please multiply the number of Classes in which you seek to register the mark by the Government Fee listed on this Schedule (Classes X Fee = Government Fee).
